China Plans to Amend the Civil Aviation Law for High-quality Development
On February 24, the draft amendment to the Civil Aviation Law was submitted for its first review at the 14th Session of the Standing Committee of the 14th National People's Congress. The amendment aims to defend the nation's airspace sovereignty and civil aviation rights, ensure safe and orderly implementation of civil aviation activities, protect the legitimate rights and interests of all parties involved in civil aviation activities and promote the high quality development of the civil aviation sector.
Civil Aviation Law is a fundamental law regulating civil aviation activities. The draft amendment consists of 15 chapters with 255 articles in total, comprehensively revising and improving the existing Civil Aviation Law. The main revisions include strengthening safety guarantee for civil aviation activities, granting the pilot-in-command the authority to take necessary measures under special circumstances, and clearly prohibiting behaviors that disrupt the order of civil aviation transport, such as unauthorized opening of aircraft emergency doors, provoking trouble on board, and spreading rumors about civil aviation safety. The amendment also further strengthens the protection of airports, explicitly requiring them to be able to deal with unmanned aerial vehicles, and improves the access conditions for public air transport enterprises and commercial general aviation enterprises.
The main contents of the draft amendment also include promoting the development of general aviation and low-altitude economy, clearly stating that the Chinese government encourages the development of general aviation and accelerates the construction of a general aviation infrastructure network. It expands the scope of general aviation business, allowing general aviation enterprises to engage in certain scheduled transport services. The amendment also promotes the development of general aviation airports, dedicating a section specifically to "General Aviation Airports" in the chapter of "Civil Airports", stipulating the coordinated development of transport airports and general aviation airports, and ensuring the reasonable demand for airspace utilization for the development of low-altitude economy.
In addition, the draft amendment also strengthens the protection of passenger rights and interests. A dedicated section on "Passenger Rights and Interests Protection" has been added in the chapter on "Public Air Transport," with clear provisions on the timely information announcement and providing proper services to passengers in case of flight delays or cancellations. It improves the design of laws governing foreign legal relations and enhances alignment with relevant international regulations. It strengthens the supervision and management of civil aviation activities, with the addition of a new chapter on "Supervision and Management". Plus, it also strictly defines legal liability with enhanced penalties for violations.
The existing Civil Aviation Law came into effect on March 1, 1996, and has been partially amended six times since then.
